Introduction

Welcome to Sweet, a platform designed to help solopreneurs manage their finances. Please note that the information provided by Sweet is for informational purposes only and does not constitute financial advice. By using our application, you agree to comply with and be bound by the following Terms and Conditions below.

Acceptance of Terms

By using Sweet, you acknowledge that you have read, understood, and agreed to be bound by this Agreement, our Privacy Policy, and any other relevant policies or guidelines. If you do not agree with any part of this Agreement, you should refrain from using our software.

Data Privacy and Security

Data Collection: Sweet collects and processes financial data, including transaction histories, income data, and other relevant financial information from connected bank accounts, payment platforms (e.g., Square, Venmo, Zelle), and other income sources.

Data Usage: The data is used solely for the purpose of providing insights related to tax deductions, income allocation, savings, investments, and financial management.

Data Protection: We prioritize the security of your data. Sweet implements advanced security measures, including encryption and secure storage, to protect your personal and financial information from unauthorized access, disclosure, or misuse.

Data Sharing: Sweet does not share your financial data with third parties without your explicit consent, except when necessary to provide the services (e.g., working with CPAs for tax filing) or as required by law.

Use of AI, CFPs, and CPAs

AI-Driven Insights: Sweet uses AI to analyze your financial data and provide real-time educational insights and recommendations. These include identifying potential tax deductions, suggesting savings strategies, and managing income from various sources.

Certified Financial Planners (CFPs) and Certified Public Accountants (CPAs): While Sweet itself does not provide financial advice, we have licensed CFPs and CPAs available to assist you with moving money, investing, and filing your taxes. These professionals can help you take action on the recommendations provided by Sweet.

Tax Filing: Sweet assists in organizing and processing your tax return through our AI-driven insights and CPA partnerships. However, Sweet is not your tax filer. Our role is limited to assisting in processing the return; the actual filing is completed by licensed CPAs. Any errors, penalties, fees, or additional taxes due resulting from the filing are the sole responsibility of the CPA who files the return. Sweet is not responsible for any inaccuracies, misfiling, or omissions that may arise during the filing process. The CPA partner assumes all liability for the return, including indemnification for any claims arising from the return.

Financial Data Access

Sweet provides access to your financial data through a third-party service, MoneyKit (https://moneykit.com/). This service enables us to retrieve your financial information from your financial institution to provide insights. Please note that Sweet is not a payment processor and does not move funds or have access to your financial accounts in any way. All transactions and funds remain under your control and within your financial institutions.

User Responsibilities

Accuracy of Information: You are responsible for ensuring the accuracy and completeness of the financial information you provide to Sweet. This includes connecting the correct bank accounts and other payment platforms.

Compliance with Laws: You agree to comply with all applicable laws and regulations, including tax laws, when using Sweet.

Account Security: You are responsible for maintaining the security of your Sweet account. Do not share your login credentials with others, and notify us immediately if you suspect unauthorized access to your account.

Holds and Limitations

Under certain circumstances, in order to protect Sweet and the security and integrity of the network that uses the Sweet services, Sweet may, in its sole discretion, take account-level or transaction-level actions. A hold may be placed on your Sweet account.

Our decision about holds and limitations may be based on confidential criteria that are essential to our management of risk and the protection of Sweet, our customers and/or service providers. We may use proprietary fraud and risk modeling when assessing the risk associated with your Sweet account. In addition, we may be restricted by regulation or a governmental authority from disclosing certain information to you about such decisions. We have no obligation to disclose the details of our risk management or security procedures to you.

Limitations may be placed on your Sweet account to help protect Sweet and Sweet users when we notice restricted activities or activity that appears to us as unusual or suspicious. Limitations also help us collect information necessary for keeping your Sweet account open.

Indemnification and Limitation of Liability

Indemnification: You must indemnify Sweet for actions related to your Sweet account. You agree to defend, indemnify, and hold Sweet harmless from any claim or demand (including reasonable legal fees) made or incurred by any third party due to or arising out of your breach of this user agreement, your improper use of the Sweet services, your violation of any law or the rights of a third party, and/or the actions or inactions of any third party to whom you grant permissions to use your Sweet account or access our websites, software, systems.

Limitation of Liability: Sweet is an educational tool, and we assist in organizing and processing tax returns, but we are not responsible for any fees, penalties, or additional taxes due to errors or omissions in the tax filing process. Sweet’s liability for financial losses or damages is limited to the information and insights provided in the platform, but we do not have liability for the final tax return, which is managed and filed by a CPA.

Sweet’s liability is limited with respect to your Sweet account. In no event shall Sweet be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with our websites, software, systems (including any networks and servers used to provide any of the Sweet services) operated by us or on our behalf, any of the Sweet services, or this user agreement (however arising, including negligence), unless and to the extent prohibited by law.

Intellectual Property

Ownership: Sweet retains all rights, title, and interest in the app, including all software, algorithms, and content. You are granted a limited, non-exclusive license to use the app in accordance with these Terms and Conditions.

Restrictions: You may not modify, reverse-engineer, or reproduce any part of the Sweet app without our explicit consent.

Termination

Suspension or Termination: We reserve the right to suspend or terminate your account at any time for violations of these Terms and Conditions or for any other reason deemed necessary to protect the integrity of the platform.

Data Retention: Upon termination, Sweet may retain your financial data as required by law or for legitimate business purposes. However, we will no longer process your data unless required for legal reasons.

Modifications to the Terms

Sweet reserves the right to modify these Terms and Conditions at any time. Changes will be communicated through the app or via email. Continued use of the app after modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the State of Delaware. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Delaware.
